I INSTANT GOODS -TO 2-B Hi THE EL PASO TIMES, Wednesday, November 25, 1981 County seeks opinion on insurance legality By DAVID CROWDER Times staff writer County Auditor Steve Seely has asked County Attorney George Rodriguez to determine whether "the county's practice of obtaining insurance through the Insurance Placement Board of El Paso is legal." Seely, who submitted his request for a legal opinion to Rodriguez Monday, has said he will seek an answer from the Texas attorney general's office if necessary. A spokesman for the attorney general's office two weeks ago said the county and city probably are violating the state's competitive bidding law by awarding insurance contracts through the placement board. The procedure also used by area school districts, the Public Service Board and other governmental units apparently has gone unquestioned for decades in El Paso County. Two El Paso independent insurance agents recently charged the placement board was monopolistic and has not sought the lowest insurance rates for local governments through the 45- member El Paso Insurance Agents Association. Seely said he was glad to see the issue raised and decided to seek a formal opinion on the legality of an arrangement that has not been exa-.

mined in the seven years he has been with the county. "I want to assure myself that what we're doing is correct or, if not, that should change our ways," Seely said. "I'm just trying to do what's right." Seely referred to a state law that gives a county auditor power to go directly to the attorney general if the county attorney "fails or refuses to answer the auditor's request or if the auditor disagrees with the county attorney's opinion, or believes that it is in conflict with former opinions of the attorney general's State law requires counties to seek bids on contracts exceeding $3,000, except where certain professional services are involved. Seeking bids for the services of lawyers, architects, engineers or accountants is prohibited. Cities must seek bids on contracts that involve more than $5,000.

Pair indicted in murder El Pasoans George Bustos and Joe Mizcles were indicted by the 34th District Court grand jury, Tuesday in last week's murder 22-year-old Illinois man.
